In many situations, “physical” custody is awarded to one parent as the sole custodian, however parents may share physical custody jointly. “legal” custody is a separate and distinct consideration. The Courts start their analysis from a presumption that both parents are presumed to have the capacity to jointly share “legal” custody. “legal” custody refers to a parent’s rights to have access to the minor’s school, religious, medical, dental and other significant records. Parents are also required to inform the other parent of any medical/school emergency that may arise when the child is in his/her care. A parent may lose their “legal” custody rights or they may be suspended, depending upon the offending act and circumstances.
The divorce judgment will specify the terms of the non-custodian’s parenting time. Depending upon the circumstances between the father and mother, parenting time may be generalized or rigorous. Specific times and locations may be identified for the exchange of the minor(s) from one parent to the other.
