Petipren -v- Rodney Jaskowski and the Village of Port Sanilac, case number 2009-032990-NO.  The Appellate Court noted that "none of the published decisions in this state have considered a situation involving conduct by a police chief that occurred when the chief was acting as an ordinary police officer rather than within his capacity as the highest executive official of a level of government."  This case may be cited by claimants in future cases to protect their interests against improper and unauthorized actions of elected officials, individuals who tend to forget who elected them into their position of authority.
