The Cutler Law Firm represents clints throughout Oakland County, Washtenaw County, Livingston County, Macomb County, Wayne County and throughout the State of Michigan who are interested in securing the best physical custody arrangment for their children. When parents divorce, the divorce judgment/decree will indicate which party is awarded physical custody over the minor child(ren). Physical custody may also be shared (jointly). The decree may also specify the primary physical residence of the minor(s). Each of these specifications have a dramatic effect on the children, his/her relationship with the parents, the amount of child support and there are tax ramifications that must also be considered. The tax code is always changing and or that reason, The Cutler Law Firm utilizes the assistance of preeminent tax and accounting experts who provide our clients with invaluable advice.
In many situations, “physical” custody is awarded to one parent as the sole custodian, however parents may share physical custody jointly. “legal” custody is a separate and distinct consideration. The Courts start their analysis from a presumption that both parents are presumed to have the capacity to jointly share “legal” custody. “legal” custody refers to a parent’s rights to have access to the minor’s school, religious, medical, dental and other significant records. Parents are also required to inform the other parent of any medical/school emergency that may arise when the child is in his/her care. A parent may lose their “legal” custody rights or they may be suspended, depending upon the offending act and circumstances.
The divorce judgment will specify the terms of the non-custodian’s parenting time. Depending upon the circumstances between the father and mother, parenting time may be generalized or rigorous. Specific times and locations may be identified for the exchange of the minor(s) from one parent to the other. The Cutler Law Firm believes that the parents need to have an opportunity to work out these arrangement between themselves. We will not create a problem where no problem exists, however you will know what options that are available to you, and more importantly, what the benefits and detriments of each option. If the discussions falter, we are there to step in to get the best arrangement for you and your children.
