In many cases, the payor's occupational license, driver's license or sporting license may be suspended by reason of an arrearage. When the accrued support arrearage exceeds the amount of two months of periodic payments, the suspension of these licenses may motivate the payor to satisfy their payment. Orders to deduct funds from a payor's periodic pay check may be secured, and if the problem persists, the prosecutor's office will be called upon to issue a criminal complaint and warrant for the arrest of the payor.
The Law Regarding The Collection of Support Payments
The basis for the Friend of the Court's enforcement responsibilities lies in the Friend of the Court Act, MCL 552.501 et. seq. and the Support and Parenting Time Enfrcement Act, MCL 552.601 et. seq. Remember that the Friend of the Court can only service those cases that have been designated as Friend of the Court type cases. This designation is established at the time of filing.
Due to the increased work load and financial concerns, several county courthouses have discontinued enforcement of spousal support only cases.
